These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and NxCreate ("we," "us," or "our") governing your access to and use of the NxCreate platform, including all associated websites, APIs, tools, and services (collectively, the "Service").
By creating an account, accessing, or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately discontinue use of the Service.
02 — Eligibility
Eligibility
You must be at least 13 years of age to use NxCreate. If you are under 18, you represent that you have obtained parental or guardian consent to use the Service. By using NxCreate, you represent and warrant that you meet the eligibility requirements above and that all information you provide is accurate and current.
We reserve the right to refuse access to anyone who does not meet these requirements or who misrepresents their eligibility.
03 — Account
Your Account
You are responsible for maintaining the confidentiality of your account credentials, including your password and any active session tokens. You agree to notify us immediately at contact@nxcreate.com if you suspect unauthorized access to your account.
All activity that occurs under your account is your sole responsibility. NxCreate will not be liable for any loss or damage arising from your failure to secure your credentials.
🔐 We strongly recommend enabling Two-Factor Authentication (2FA) via your linked Telegram account to protect your NxCreate account from unauthorized access.
04 — Acceptable Use
Acceptable Use
NxCreate is built for developers and teams deploying Telegram bots and automation workflows. The following uses are explicitly permitted:
Building, deploying, and managing Telegram bots for personal or commercial purposes.
Using our API to programmatically manage bots and scripts within your own projects.
Storing bot tokens and scripts solely for the purpose of running your own authorized bots.
Integrating NxCreate with third-party services you own or have authorization to connect.
05 — Prohibited
Prohibited Conduct
The following activities are strictly prohibited and will result in immediate account suspension or permanent termination without refund:
Spam & Mass Messaging — using the Service to send unsolicited, bulk, or automated messages to users who have not consented to receive them.
Illegal Activity — using the Service in connection with any activity that violates applicable local, national, or international law or regulation.
Malware & Exploits — deploying scripts or bots that contain malicious code, exploit vulnerabilities, or attempt to compromise other systems or users.
Harassment & Abuse — using the Service to harass, threaten, impersonate, or harm any individual or group.
Platform Abuse — attempting to circumvent rate limits, access controls, authentication mechanisms, or any other security measures of the Service.
Unauthorized Resale — reselling, sublicensing, or white-labeling the Service without express written permission from NxCreate.
Credential Abuse — storing or using third-party Telegram bot tokens that you do not own or have no authorization to manage.
Data Scraping — automated extraction of data from the NxCreate platform beyond what is permitted by the API without prior written consent.
⚠️ Violation of Telegram's own Terms of Service and Bot API policies while using NxCreate is also a violation of these Terms. You are solely responsible for ensuring your bots comply with all Telegram policies.
06 — Your Content
Your Content
You retain full ownership of all scripts, configurations, and content you create or upload to NxCreate ("Your Content"). By using the Service, you grant NxCreate a limited, non-exclusive, royalty-free licence to store and process Your Content solely for the purpose of providing the Service to you.
You represent and warrant that Your Content does not infringe any third-party intellectual property rights, violate any applicable law, or breach any obligation of confidentiality. You are solely responsible for the legality, accuracy, and appropriateness of all content you deploy through the platform.
We do not review scripts or bot content proactively. However, we reserve the right to remove any content that we determine, in our sole discretion, violates these Terms or applicable law.
07 — Intellectual Property
Intellectual Property
All elements of the NxCreate platform — including but not limited to its source code, user interface, design, branding, logos, and documentation — are the exclusive property of NxCreate and are protected by applicable intellectual property laws.
Nothing in these Terms grants you any right, title, or interest in NxCreate's intellectual property. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our express prior written consent.
08 — Availability
Service Availability
We strive to maintain high availability and reliability. However, we do not guarantee that the Service will be uninterrupted, error-free, or available at all times. Scheduled maintenance, unexpected outages, or factors beyond our reasonable control may cause temporary unavailability.
NxCreate shall not be liable for any losses, damages, or inconvenience arising from service interruptions or downtime. We will make reasonable efforts to communicate planned maintenance in advance.
09 — Termination
Termination
You may delete your account at any time by contacting us at contact@nxcreate.com. Upon account deletion, your data will be removed in accordance with our Privacy Policy.
We reserve the right to suspend or permanently terminate your account at any time, with or without notice, if we determine that you have violated these Terms, engaged in conduct harmful to other users or the platform, or for any other reason at our sole discretion.
Upon termination, all licences granted to you under these Terms will immediately cease. Provisions that by their nature should survive termination — including intellectual property, limitation of liability, and dispute resolution — shall continue to apply.
10 — Liability
Limitation of Liability
To the fullest extent permitted by applicable law, NxCreate and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, or business opportunities — arising from your use of or inability to use the Service.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
In jurisdictions that do not permit the exclusion of certain warranties or the limitation of liability, our liability will be limited to the maximum extent permitted by law.
11 — Changes
Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will notify you via email or an in-app notice at least 14 days before the updated Terms take effect. Minor changes (such as grammatical corrections or clarifications that do not alter the substance of our agreement) may be made without notice.
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service before the changes take effect.
