Terms of Service

By accessing or using the NxCreate platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users including free-tier users, paid subscribers, and API consumers. NxCreate reserves the right to update these Terms at any time with 14 days' notice to registered users.

NxCreate provides a managed infrastructure platform for deploying, scaling, and monitoring Telegram bots. The Service includes a web-based editor, deployment pipeline, webhook management, analytics dashboard, and API access depending on your subscription plan. Features and limits vary by plan as described on our pricing page. NxCreate may modify, suspend, or discontinue features at any time with reasonable notice.

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You must provide accurate information and keep it up to date. Accounts may not be shared or transferred. You must be at least 13 years old to create an account.

You agree not to use the Service to: • Deploy bots that send unsolicited messages (spam) or violate Telegram's Terms of Service • Engage in illegal activity including fraud, phishing, or distribution of malware • Attempt to gain unauthorized access to NxCreate systems or other users' accounts • Mine cryptocurrency or engage in resource-intensive activities beyond your plan limits • Circumvent rate limits, billing systems, or usage restrictions • Redistribute or resell the Service without authorization NxCreate may suspend or terminate accounts that violate these restrictions without prior notice.

Paid plans are billed monthly or annually as selected at checkout. All prices are in USD. Payments are processed via our payment providers — NxCreate does not store full payment details. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time from your account settings; access continues until the end of the current billing period, after which no refunds are issued for partial periods. NxCreate reserves the right to modify pricing with 30 days' notice. Continued use after the effective date constitutes acceptance of new pricing.

You retain full ownership of the bot code and content you create and deploy through NxCreate. By using the Service you grant NxCreate a limited license to host, execute, and transmit your code solely for the purpose of operating the Service. The NxCreate platform, branding, documentation, and all associated intellectual property are owned by NxCreate and may not be copied, reproduced, or distributed without prior written consent.

NxCreate targets 99.9% monthly uptime for paid plans. Scheduled maintenance windows will be announced at least 24 hours in advance on our status page. In the event of prolonged outages attributable to NxCreate, affected paid users may be eligible for service credits at our discretion. NxCreate is not liable for outages caused by third-party providers (Telegram, cloud infrastructure), force majeure events, or actions taken by users.

To the maximum extent permitted by law, NxCreate shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to lost profits, data loss, or business interruption. NxCreate's total liability for any claim related to the Service shall not exceed the amount paid by you in the 3 months preceding the claim.

You may terminate your account at any time. NxCreate may suspend or terminate your account for violation of these Terms, non-payment, or prolonged inactivity on free-tier accounts (90+ days with no deployments). Upon termination, your bot deployments will be shut down and your data will be deleted within 90 days in accordance with our Privacy Policy.

These Terms are governed by the laws of the applicable jurisdiction. Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration. If you have questions about these Terms, contact [email protected].
